These General Terms and Conditions (“Terms”) govern the use of the website www.alamoda.cz, operated by Alamoda. These Terms apply to all agreements concluded between Alamoda and the consumer, including all product sales, services, customer interactions, and transactions carried out via the website or associated platforms (e.g. Shopify, payment providers, logistics partners).

By visiting the website, purchasing a product, or engaging with our services in any capacity, you acknowledge and agree to be legally bound by these Terms. If you do not agree with any provision herein, you must not proceed with using the website or placing an order.

These Terms form an integral part of every order and customer relationship. They apply in addition to our Privacy Policy, Returns Policy, Shipping Policy, and any written correspondence or agreements made between Alamoda and the user.

Alamoda reserves the right to update, amend, or replace any part of these Terms at any time. Updates will be posted on this page and apply as soon as they are visible. Your continued use of the website after such changes constitutes acceptance of the modified Terms.


SECTION 1 – DEFINITIONS

1.1 “Alamoda”, “we”, “us”, “our” refers to the company operating the website www.alamoda.cz and all associated digital services, marketing, and fulfillment operations. Alamoda is the trade name under which the registered legal entity conducts its international e-commerce activities. The company sells women's fashion items, including dresses, bodysuits, tops, accessories, sets, and footwear, via an online-only model supported by Shopify and external logistics partners.

1.2 “Customer”, “you”, or “user” means any individual (natural person) or legal entity that accesses, browses, uses, or places an order through the Alamoda website. In most cases, the customer is acting in a private capacity and is entitled to protection under applicable consumer law.

1.3 “Consumer” is defined in accordance with EU Directive 2011/83/EU on consumer rights as a natural person who is acting for purposes which are outside his trade, business, craft, or profession.

1.4 “Agreement” or “Contract” refers to the legally binding arrangement between Alamoda and the customer formed when an order is placed and accepted. This agreement includes these Terms and Conditions, the order confirmation, the invoice, and any applicable returns or shipping policies.

1.5 “Products” or “items” means all physical goods listed for sale by Alamoda through the website, including all apparel and accessories currently offered or made available in the future.

1.6 “Services” includes all website functionality and digital infrastructure provided by Alamoda to customers, such as account management, order processing, checkout, customer support, promotional tools, reviews, email notifications, and return handling.

1.7 “Order” refers to the completed purchase request made by a customer through the Alamoda website, including selection of products, confirmation of details, payment, and submission via the digital checkout.

1.8 “Working Day” or “Business Day” means any calendar day excluding Saturday, Sunday, and officially recognized holidays in the Netherlands. These are the days during which customer service operates and orders are processed.

1.9 “Right of Withdrawal” refers to the statutory right of consumers to cancel the Agreement within a specified period without giving any reason. In accordance with EU law, the standard cooling-off period is 14 days, which Alamoda voluntarily extends to 30 days.

1.10 “Durable Medium” means any tool that allows the customer or Alamoda to store information in a way that is accessible for future reference, such as email, PDF, or printed paper. The information must be stored in a form that remains unchanged over time and is suitable for legal proof or recordkeeping.

1.11 “Third Party Services” refers to any technology, application, logistics platform, or payment processor used by Alamoda but operated independently, such as Shopify (e-commerce), Stripe (payments), DHL/FedEx (shipping), or apps that provide size charts, product reviews, fraud checks, or marketing automation.

1.12 “Force Majeure” means any situation beyond the reasonable control of Alamoda that prevents the fulfillment of contractual obligations. This includes, but is not limited to, war, riot, terrorism, pandemics, natural disasters, governmental restrictions, internet outages, or international supply chain disruptions.


SECTION 2 – IDENTITY OF THE SELLER

2.1 Alamoda is the commercial name of the online fashion store operated through the website www.alamoda.cz. The seller is a legally registered business entity responsible for all commercial activity conducted on the website, including the sale, promotion, and distribution of fashion products to consumers worldwide.

2.2 The legal entity behind Alamoda is registered in the Netherlands and is subject to Dutch law and international consumer trade regulations. The business is incorporated under the trade register of the Dutch Chamber of Commerce (Kamer van Koophandel), with its official registration number and VAT number 86296140.

2.3 Alamoda operates solely through digital platforms and does not maintain any physical retail location, office, or showroom accessible to the public. The registered address of the company is used for administrative and legal purposes only and may not be used for personal visits or unsolicited returns.

2.4 All product listings, customer service, and transactional processing are hosted on the Shopify platform. Shopify Inc. provides the technical infrastructure for checkout, payments, order management, and data protection. However, the contractual relationship and legal responsibility for orders and customer support lie exclusively with Alamoda.

2.5 Official communication between customers and Alamoda takes place via email. All inquiries, complaints, legal notices, and customer service requests must be submitted via podpora@alamoda.cz. Alamoda commits to responding within a reasonable timeframe, typically within 24 to 48 working hours, excluding weekends and national holidays.

2.6 Alamoda may, at its discretion, provide additional communication channels (such as contact forms, live chat, or social media messaging), but such channels do not replace email as the formal method for legally relevant correspondence or customer support.


SECTION 3 – APPLICABILITY OF THE TERMS

3.1 These Terms and Conditions apply to every offer, order, agreement, and transaction entered into between Alamoda and any customer, regardless of the customer’s country of residence. The Terms govern all use of the Alamoda website and all legal relationships arising from digital interactions, purchases, deliveries, or service inquiries initiated through the platform.

3.2 By accessing the website, placing an order, creating an account, subscribing to marketing communications, or otherwise using any part of the Alamoda service, the customer confirms their acceptance of these Terms and agrees to be legally bound by them. This agreement applies regardless of whether the user completes a purchase.

3.3 These Terms are made available to all customers before concluding a transaction, either via a direct hyperlink at checkout or through the permanent footer of the website. Customers are expected to read them carefully. Proceeding with any action on the website constitutes full and unconditional acceptance.

3.4 Alamoda may include specific or temporary conditions alongside certain product pages, promotions, or announcements (e.g., discount limitations, shipping exclusions, size-specific restrictions). In cases of contradiction between these Terms and product-specific terms, the interpretation most favorable to the consumer will prevail—provided this does not violate mandatory consumer law.

3.5 These Terms supersede any other purchasing conditions, terms, or policies submitted or claimed by the customer unless explicitly accepted in writing by an authorized representative of Alamoda. Verbal statements, informal emails, or chat messages shall not alter the validity or interpretation of these Terms unless confirmed in writing and signed by Alamoda.


SECTION 4 – ONLINE STORE TERMS

4.1 By placing an order through the Alamoda website, the customer enters into a legally binding agreement with the seller. The customer confirms that they are of legal age in their country of residence, or that they are authorized by a legal guardian to act on their behalf. Alamoda reserves the right to reject any order placed by a minor without such authorization.

4.2 All product listings, prices, and availability shown on the website are offered on a “subject to change” basis. While Alamoda strives to keep all information up to date, errors may occur and stock levels are not always reflected in real time. A submitted order is considered an offer by the customer and is only binding once confirmed by Alamoda via email.

4.3 The Alamoda webshop operates 24/7 via an automated online platform. Orders can be placed at any time. However, order processing, support response, and shipping preparations are only conducted on official business days. Orders placed on weekends or public holidays will be processed on the next available working day.

4.4 Customers are responsible for selecting the correct size, color, and quantity when placing an order. Alamoda provides general size guides and product descriptions for reference purposes, but the final selection lies with the customer. Incorrect choices by the customer do not constitute a defect and are subject to the standard return policy.

4.5 Orders may be subject to automatic fraud prevention checks. In case of suspected fraudulent behavior—such as use of stolen payment credentials, mismatched shipping data, suspicious browser patterns, or IP masking—Alamoda reserves the right to delay, cancel, or further verify the order. Customers may be required to provide additional documentation before the order is processed.

4.6 The checkout process includes a time-limited reservation of items in the cart. If payment is not completed within the set timeframe (e.g., 10 minutes), items may be released to other buyers. Alamoda does not guarantee the availability of any product until the payment has been fully received and confirmed.

4.7 Alamoda reserves the right to limit the quantity of items per order, per customer, per region, or per promotional campaign to prevent misuse, resale, or abuse of discount codes. Multiple orders suspected to be made by the same person using different names or addresses may be flagged and cancelled without prior notice.

4.8 Upon successful completion of the order, the customer will receive an automatic email confirmation detailing the products ordered, total price, shipping address, and expected handling time. This confirmation does not yet guarantee final shipment, which is subject to stock verification and risk assessment.

4.9 Alamoda retains ownership of all products until full payment has been received and shipment has been accepted by the courier. If payment is reversed, rejected, or disputed without valid legal grounds, Alamoda reserves the right to reclaim goods, deny future access to the store, and seek compensation for incurred losses.


SECTION 5 – PRODUCTS AND PRESENTATION

5.1 All products listed on the Alamoda website are presented with the intention to provide accurate and clear visual and textual descriptions. This includes product titles, sizing information, color variants, materials used, styling notes, and pricing. However, minor variations may occur due to digital representation limitations or supplier-side updates.

5.2 Product photos, mockups, videos, or close-up details are illustrative and may not reflect the exact scale, texture, fabric behavior, or color accuracy as seen in person. Screen resolution, lighting conditions, and device settings may cause visual discrepancies. Alamoda is not liable for any perceived mismatch between product expectations and actual appearance based on screen differences.

5.3 Descriptions and specifications provided for each product are created using supplier input, internal product research, and customer feedback. While every effort is made to ensure factual accuracy, Alamoda does not guarantee that every detail is 100% error-free. Minor deviations in fabric blend, stitching details, or decorative elements may occur within standard production tolerances.

5.4 All size recommendations are based on general international sizing tables and product fit feedback. However, due to variation in manufacturing batches, body types, and fabric stretch, a 100% accurate fit cannot be guaranteed. Customers are encouraged to consult the size guide carefully before ordering. Size mismatches are not considered product defects.

5.5 Prices shown for each product include VAT where applicable and are listed in australian dollars (AUD) unless otherwise indicated. The displayed price does not include optional services such as shipping insurance, express delivery upgrades, or customs handling fees, unless clearly marked as “included.”

5.6 Alamoda reserves the right to make updates to product listings, modify prices, change available stock, adjust fabric sourcing, or discontinue items at any moment without notice. Changes may also apply to items already featured in promotional material if deemed necessary due to supply chain disruptions or quality control revisions.

5.7 Products marked as “Limited Edition,” “Final Sale,” “Outlet,” or “Non-returnable” are excluded from exchange or return eligibility except in the case of legally recognized manufacturing defects. These items are clearly labeled as such at the point of purchase and may include pricing reductions due to end-of-line clearance or time-limited drops.

5.8 Alamoda does not offer customization or made-to-measure options. All products are shipped as-is, based on supplier production batches. Requests for adjustments, alterations, or special sizing accommodations cannot be honored unless explicitly offered in a dedicated product line and stated clearly on the product page.


SECTION 6 – PRICING, PAYMENTS & CHECKOUT

6.1 All prices displayed on the Alamoda website are inclusive of VAT (Value Added Tax) where applicable. Customers within the European Union will not be charged additional VAT beyond the prices listed, except where explicitly noted (e.g., gift wrapping, insurance, or express shipping upgrades).

6.2 The total amount due at checkout consists of the item subtotal, shipping fee (if applicable), and any optional add-ons such as shipping insurance. No hidden charges are applied. The final total is clearly shown before payment and must be approved by the customer before completing the transaction.

6.3 Alamoda accepts a range of secure payment methods, including but not limited to:
– Visa, MasterCard, AMEX, Maestro
– PayPal
– SOFORT, Giropay, UnionPay
The availability of these methods depends on the country of checkout and may be limited due to provider restrictions.

6.4 All transactions are securely encrypted using the latest SSL (Secure Socket Layer) protocols. Alamoda does not store full credit card data on its servers. Payment processing is handled by certified third-party providers in compliance with PCI-DSS standards.

6.5 Orders are only considered “confirmed” once payment has been successfully processed and a confirmation email is sent. If a payment fails, is declined, or is reversed during or after checkout, the order will be automatically cancelled or held for review.

6.6 In the case of chargebacks or unauthorized payment disputes, Alamoda reserves the right to block the associated customer account, cancel future orders, and pursue recovery of financial damages. False claims of fraud or misuse of buyer protection services will result in blacklisting and possible legal action.

6.7 Customers are responsible for ensuring that their billing information is complete and accurate. Mismatched billing details may cause verification delays or failed transactions. Alamoda is not liable for losses or missed delivery due to incorrect payment details.

6.8 Promotional codes, gift vouchers, and store credits may be applied at checkout under the following conditions:
– Only one code may be used per order
– Codes may not apply to discounted items or bundles
– Expired or misused codes will be rejected automatically
Alamoda reserves the right to cancel any order where misuse of promotional codes is detected.

6.9 Customers may opt-in to save their billing information for faster future checkout. This is done securely and only with explicit consent. You may manage or remove your saved data at any time via your customer account or by contacting podpora@alamoda.cz.

 

SECTION 7 – SHIPPING, DELIVERY & FULFILLMENT

7.1 All orders placed through the Alamoda website are processed within 1 to 2 business days (excluding weekends and public holidays). This refers to order fulfillment and handover to our logistics partners, not final delivery.

7.2 Alamoda ships globally from international warehouses or third-party suppliers, depending on product availability and your delivery location. As such, delivery times vary depending on the destination and carrier performance.

7.3 Standard delivery time is estimated between 8 to 10 business days after dispatch. This is an average, not a guaranteed timeframe. Factors such as customs inspection, remote areas, or logistical congestion may cause occasional delays.

7.4 All shipping timelines provided at checkout or via email are indicative. Alamoda does not guarantee delivery by a specific date, especially during peak periods (e.g., holidays, sales events, strikes, pandemics).

7.5 Customers are responsible for entering a correct and complete shipping address at checkout. Alamoda is not liable for packages lost, delayed, or returned due to incomplete or incorrect address details. Any costs associated with reshipping must be covered by the customer.

7.6 Once your order has been shipped, you will receive a confirmation email with a tracking number. Tracking may take up to 48 hours to become active, depending on the carrier. It is the customer’s responsibility to monitor their tracking and take appropriate action if issues arise.

7.7 In the event of a missed delivery attempt or failure to collect the parcel from a pickup point, the carrier may return the package to the sender. If the package is returned to Alamoda due to non-collection, incorrect address, or refusal of delivery, reshipping fees and a restocking fee may apply.

7.8 Shipping insurance is available at checkout for an additional fee (e.g., $4.99). This covers loss, theft, or damage during transit. If you decline shipping insurance, Alamoda is not liable for these risks once the package has left our warehouse.

7.9 Alamoda is not responsible for customs delays, border inspections, or import procedures in your country. These events are outside our control and may cause delays that extend beyond our estimated delivery window.

7.10 If your parcel appears to be lost in transit or tracking shows no movement for more than 10 business days after dispatch, please contact our support team at podpora@alamoda.cz. We will investigate with the carrier and offer an appropriate resolution. Claims must be made within 30 days from the shipping date.

7.11 Alamoda reserves the right to split large orders into multiple shipments. This does not impact the total shipping cost charged to the customer but may result in different delivery dates per package. Each shipment will have its own tracking number.


SECTION 8 – RETURNS, REFUNDS & EXCHANGES

8.1 Alamoda offers a 14-day return window from the date of delivery. You have the right to withdraw from the purchase agreement without giving any reason within 14 calendar days after receiving your order. This is in accordance with EU consumer protection laws.

8.2 In addition to this statutory right of withdrawal, we offer a 30-day quality guarantee on all products. This means that if a product develops a defect, shows abnormal wear, or arrives damaged due to a manufacturing or shipping error, you may file a claim for a replacement, partial refund, or store credit within 30 days of receipt.

8.3 To be eligible for a return or guarantee claim, the item must:
– Be unused, unwashed, and in its original condition for standard returns
– Show clear evidence of defect or damage for quality claims
– Have all original tags and hygiene seals (if applicable) intact
– Be returned in its original or adequate packaging to prevent damage in transit

8.4 Items that are worn, washed, stained, misused, or returned in poor condition will not be accepted and will be returned at the customer’s expense. If fraud or excessive wear is detected, Alamoda reserves the right to refuse the claim.

8.5 Excluded from returns or refunds are:
– Intimate items (e.g., bodysuits, lingerie, swimwear, earrings)
– Final sale or clearance items (explicitly stated on product page)
– Orders returned without prior authorization
– Refused deliveries or unclaimed parcels

8.6 To initiate a return or claim, contact podpora@alamoda.cz with:
– Your full name and order number
– The item(s) concerned
– Clear photos showing the issue (for damaged/defective items)
– A brief explanation of the reason for return or claim

8.7 Standard return shipping costs are the responsibility of the customer. If you are claiming under the 30-day guarantee for a defective or incorrect item, Alamoda may reimburse reasonable return shipping upon validation.

8.8 Once your return is received and inspected, we will notify you by email. Approved returns are refunded within 5–10 business days to the original payment method. The refund covers the value of the returned item(s) only. Shipping costs, insurance, or customs duties are non-refundable.

8.9 Exchanges are not currently supported. If you need a different size or color, please return the item for a refund and place a new order.

8.10 If your item was damaged in transit or defective upon arrival, you must contact us within 72 hours of delivery with full photographic proof. If verified, we will offer a free replacement, store credit, or refund.

8.11 Alamoda monitors return behavior. Accounts abusing the system (e.g., repeated excessive returns, wardrobing, false claims) may be suspended or permanently blocked. We reserve the right to reject returns that do not meet our conditions.

8.12 If an order is returned to us due to non-collection, refusal of delivery, or customs issues, a restocking fee and all related shipping charges will be deducted from any potential refund. In some cases, no refund may be issued.


SECTION 9 – DAMAGED, DEFECTIVE & MISSING ITEMS

9.1 All orders are thoroughly checked by our fulfillment partners before shipment. However, due to the nature of global logistics and dropshipping, incidents such as damage, defects, or missing items can occur. Alamoda takes these situations seriously and will assist you in resolving any such issues promptly and fairly.

9.2 If you receive a damaged or defective item, you must notify us within 72 hours of delivery by emailing podpora@alamoda.cz. Your message must include:
– Your full name and order number
– A clear description of the issue
– Photographic evidence showing the product, damage, and packaging
– A photo of the shipping label

9.3 For claims to be valid:
– The item must not have been worn, washed, or altered after delivery
– The damage or defect must be clearly visible and not caused by misuse or negligence
– Packaging must be retained for inspection if requested
– Reports made after the 72-hour window may not be eligible for compensation

9.4 Alamoda reserves the right to request the item be returned to us or inspected by a third-party partner before issuing compensation. If a return is required, return costs for approved claims will be reimbursed, or a prepaid label may be provided depending on your location.

9.5 Valid outcomes for approved claims include:
– A free replacement (subject to availability)
– A partial refund (if minor issue or cosmetic damage)
– A full refund (if item is unwearable or out of stock)
– A store credit or discount code (in certain cases)

9.6 We do not offer compensation for:
– Minor loose threads, creasing due to transit, or slight color variations
– Damage caused by improper handling or washing by the customer
– Products with defects reported after the item has been worn
– Items delivered over 30 days ago (warranty period expired)

9.7 In the event that a package arrives incomplete (i.e., missing an item), you must notify us within 72 hours of delivery confirmation. Include:
– A photo of the received items
– Your order number
– Confirmation that the parcel was sealed and intact upon arrival

9.8 If our records show all items were shipped correctly and the package was delivered without signs of tampering, Alamoda may require a formal lost/stolen claim to be filed with the shipping carrier. We will support you in that process.

9.9 If your order arrives without shipping protection (when not selected at checkout), Alamoda is not responsible for packages that are damaged, lost, or stolen in transit. For full coverage against such issues, we recommend selecting Shipping Insurance during checkout for a small additional fee.

9.10 Alamoda will not issue refunds for claims proven to be fraudulent, exaggerated, unsupported by evidence, or submitted well beyond reasonable timeframes. All claim decisions are final.


SECTION 10 – PERSONAL INFORMATION & DATA USE

10.1 By placing an order, creating an account, subscribing to our newsletter, or interacting with the website in any way, you provide Alamoda with personal information. This may include, but is not limited to:
– Full name
– Shipping and billing address
– Email address
– Phone number
– Payment details (processed via encrypted third-party gateways)
– Purchase history
– Device or browser data (via cookies or tracking pixels)

10.2 Your data is collected and processed in accordance with the General Data Protection Regulation (GDPR) for EU-based users, and with applicable privacy laws for other jurisdictions. The data controller is Alamoda. For any privacy-related inquiries, contact us at podpora@alamoda.cz.

10.3 We use your personal data for the following purposes:
– Fulfilling and delivering your orders
– Processing payments securely
– Communicating updates about your purchase
– Handling returns, refunds, or disputes
– Providing customer support
– Sending promotional content (only if you have opted in)
– Analyzing website behavior to improve user experience and store performance
– Preventing fraud and abuse

10.4 Your data may be shared with verified third-party service providers strictly for operational purposes, such as:
– Payment processors (e.g. Stripe, PayPal)
– Fulfillment and logistics partners
– Email marketing tools (e.g. Klaviyo or Mailchimp)
– Customer support platforms
– Fraud prevention and analytics tools

These partners are contractually obligated to process your data securely and only for the specific purposes defined by Alamoda.

10.5 Alamoda will never sell, rent, or trade your personal information to unrelated third parties. We only share data when absolutely necessary to provide our service, or when required by law or legal proceedings.

10.6 You have the right to:
– Access your data
– Correct inaccuracies
– Request deletion (“Right to be Forgotten”)
– Withdraw consent for marketing
– Object to processing under legitimate interest
– Receive a copy of your data in a portable format

10.7 All transactional and personal data is securely stored using encryption, access controls, and security best practices. Sensitive data (e.g. payment details) is not stored by Alamoda, but processed securely by certified third parties.

10.8 When you opt in to receive marketing emails or SMS messages, you grant us permission to send you promotions, early access offers, and brand updates. You can unsubscribe at any time via the unsubscribe link in the message or by contacting us.

10.9 If you use social media logins, chat tools, or other third-party integrations, those services may share certain data with us (such as your profile info or preferences). Always review their privacy settings.

10.10 We use cookies and tracking pixels (e.g. Meta Pixel, Google Analytics) to understand visitor behavior and improve marketing effectiveness. By using the website, you consent to our use of such tools. You can manage cookie preferences via your browser or consent popup.

10.11 Alamoda may retain anonymized or aggregated data (non-identifiable) for statistical, analytical, or reporting purposes, even after your personal data has been deleted.

10.12 In case of a data breach affecting your personal information, you will be notified within 72 hours in accordance with GDPR and applicable privacy laws. We take every reasonable measure to prevent unauthorized access, leakage, or misuse.


SECTION 11 – TAXES, DUTIES & SHIPPING FEES

11.1 All prices shown on the Alamoda website are inclusive of Value Added Tax (VAT) where applicable. This means that the amount displayed during checkout represents the final retail price for consumers in most regions, including applicable domestic sales taxes.

11.2 However, due to the international nature of our business model and the fact that most items are shipped directly from our overseas fulfillment partners, additional import duties, customs fees, or local taxes may apply depending on your destination country. These fees are determined by your local customs authority and are not controlled or imposed by Alamoda.

11.3 Customers are solely responsible for any import-related charges. These may include, but are not limited to:
– Import duties
– Customs clearance costs
– VAT adjustments upon arrival
– Storage or inspection fees imposed by your national customs agency

Failure to pay these charges may result in delayed delivery, returned parcels, or the destruction of your shipment by customs — all of which are outside Alamoda’s responsibility.

11.4 In the event a customer refuses to pay customs duties or fails to complete necessary clearance actions, and the parcel is returned to Alamoda or our supplier, we reserve the right to deduct the return shipping cost, any customs penalties, and administrative processing fees from the total refund.

11.5 Shipping costs, where applicable, are displayed clearly at checkout. Our shipping fees may vary depending on your location, order volume, shipping method (e.g. Standard or Express), or the presence of active promotions (e.g. free shipping thresholds).

11.6 Shipping fees cover:
– Logistics from our warehouse to your door
– Packaging and handling
– Third-party courier costs
– Basic tracking information (if available for your country)

They do not include insurance unless explicitly selected during checkout, nor do they cover duties or customs charges post-arrival.

11.9 Shipping timelines are estimated based on courier performance and destination:

Please note: weekends, public holidays, customs clearance, and unforeseen delays (e.g. weather, strikes, etc.) are outside of our control and may impact these delivery estimates.

11.10 If you input incorrect or incomplete shipping details (e.g. wrong postcode, name, or address), Alamoda is not liable for delivery failures. Any re-shipment, if possible, will require the customer to pay new shipping fees.

11.11 In the event that an order is returned to sender due to non-collection, failed delivery attempts, refusal to pay import duties, or absence at delivery address, the customer remains responsible for:
– The original shipping fee (if applicable)
– Return-to-sender costs
– Administrative restocking or processing fees

  • (h) To engage in price scraping, crawling, or automated data extraction from our website or servers without explicit written permission.

  • Return shipments not received due to customer error or lack of tracking.

14.8 Alamoda does not offer compensation for personal inconvenience, emotional dissatisfaction, missed events, or special occasions due to delays or issues with products, shipping, or customer service.

  • 15.1.5 Fraudulent use of payment methods or unauthorized transactions under your account;

  • 15.1.6 Abuse of our returns system, coupon systems, referral programs, or chargeback processes;

  • 15.1.7 Your failure to fulfill any customs, tax, or legal obligations in your country that arise from your purchase or use of our services;

16.5 You agree that it is your responsibility to review and understand these Terms in full, and that partial unenforceability does not exempt you from the remaining valid obligations herein.


SECTION 17 – TERMINATION

17.1 These Terms of Service shall remain effective until terminated by either you or Alamoda. You may terminate your agreement with Alamoda at any time by ceasing to use our website or services and notifying us of your intention to terminate via podpora@alamoda.cz.

17.2 Alamoda reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to all or part of the Service or website immediately and without prior notice, for reasons including but not limited to:

  • Violation of any provision of these Terms

  • Submission of false, misleading, or fraudulent information

  • Abusive, threatening, or harassing conduct toward staff or other users

  • Unauthorized chargebacks, disputes, or fraudulent payment behavior

  • Use of automated systems, bots, or scripts to circumvent purchasing limits or security

  • Any behavior that poses a security, operational, reputational, or legal risk to Alamoda or its customers

17.3 Upon termination:

  • Your access to the website and services shall cease immediately.

  • All outstanding orders and financial obligations shall remain payable unless explicitly canceled or refunded.

  • Any loyalty points, credits, or promotional benefits may be forfeited without compensation.

  • Alamoda may remove or delete any content associated with your account or profile.

19.2 By using this website and placing an order with Alamoda, you expressly consent to the exclusive jurisdiction and venue of the courts located in the Netherlands to resolve any disputes arising out of or relating to these Terms or the use of the Service.

19.3 If you are a consumer located within the European Union, this choice of jurisdiction and law shall not deprive you of any mandatory rights granted by the consumer protection laws of your country of residence.

19.4 You may also have the right to bring proceedings before the courts in your country of residence as permitted by applicable consumer protection laws.
